Full Text Of DSS Report Which Result To Magu's Rejection As EFCC Chairman

The Nigerian Senate on Wednesday rejected the nomination of Ibrahim Magu, acting Chairman of the Economic and Financial Crimes Commission, EFCC based on a report by the Department of State Security Services.

See text of the DSS report that condemned Magu:

RE: NOMINATION OF MR IBRAHIM MAGU MUSTAPHA AS EXECUTIVE CHAIRMAN OF ECONOMIC AND FINANCIAL CRIMES COMMISSION (EFCC) SECURITY REPORT OF THE NOMINEE

Your letter NASS/CS /SA/01/17/ 08 /02 dated 7th March 2017 requesting for security report on the above named nominee refers

The security report being requested for on Ibrahim Magu MUSTAPHA the nominee or the Executive Chairmanship position of the Economic and Financial Crimes Commission has already been submitted to the Senate via this Services’ letter No. SV.114/ 2 of 3rd October 2016
containing fourteen (14) paragraphs.

Please accept once again the assurances of the esteemed regards of the DGSS.

F. O. ADAMS
For: DIRECTOR-GENERAL, SS

August 2008, following a search at his residence during the tenure of Farida WAZIRI (AIG/Rtd) as the commission’s chairman, some sensitive EFCC documents which were not supposed to be at his disposal were discovered. He was subsequently redeployed to the police after days of detention and later suspended from the Force. In December 2010, the Police Service Commission found Magu guilty of “Action prejudicial to state security, withholding of EFCC files, sabotage, unauthorised removal of EFCC files and acts unbecoming of a Police officer,” and awarded him severe reprimand as punishment.

“4. Notwithstanding, sequel to the appointment of Ibrahim Lamorde as Chairman of the EFCC in 2011, he made the return of Magu to the EFCC a top priority. Both men had worked together at the commission when Lamorde served as Head of Operations of the agency. Magu remained a top official of the commission until he was appointed to succeed Lamorde.

“5. Magu is currently occupying a residence rented for N40m, at N20m per annum. This accommodation was not paid for from the commission’s finances but by one Umar Mohammed (Air Commodore/Rtd), a questionable businessman and ally of subject who has subsequently been arrested by this service. For the furnishing of the residence, Mohammed enlisted the Federal Capital Development Authority to award a contract to Africa Energy, a company owned by the same Mohammed to lavishly furnish the residence at the cost of N43m.

“6. Investigations show that the Acting EFCC Chairman regularly embarks on official and private trips through a private carrier, Easyjet, owned by Mohammed. In one of such trips, Magu flew to Maiduguri, alongside Mohammed and the MD of Fidelity Bank, Nnamdi Okonkwo, who was being investigated by the commission over complicity in funds allegedly stolen by the immediate past Petroleum Minister, DiezaniAlison-Madueke.

“7. Furthermore, the EFCC boss has so far maintained a high profile lifestyle. This is exemplified by his preference for First Class air travels. On 24th June, 2016, he flew Emirate Airlines’ First Class to Saudi Arabia to perform the Lesser Hajj at the cost of N2,990,196. This is in spite of Mr. President’s directive to all public servants to fly Economy Class.

“8. Investigation also revealed that Magu parades a twin personality. At one level, he is the czar who has no friends, no favourites and is ready to fight corruption to a standstill. However, with a key friend in the person of Umar Mohammed (Air Commodore/Rtd), a controversial businessman, he has betrayed the confidence reposed in him by the present administration. Whereas Magu portrays himself as very secretive, he has fostered a mutually beneficial relationship with Mohammed who, by his confession, approaches ‘clients’ for possible exploitation, favours and associated returns. This was facilitated with official secrets divulged by Magu and from which dealings he is believed to have been drawing considerable benefits.

“9. This was evidenced by the number of official and classified documents he made available to his associates, especially Mohammed. After a search of Mohammed’s premises, a forged letter of the Office of the Vice President, dated 20th May, 2016, was recovered. The letter was a fictitious investigation report from Vice President to Mr. President, requesting for approval to commence further probe into a matter allegedly involving Hon. Minister of State Petroleum. Attached to the letter were two EFCC letters dated 13th April, 2016, and another 24th March, 2016, addressed to the Vice President being investigation reports on the activities of Emmanuel Kachikwu and his brother Dumebi Kachikwu. Similarly recovered during the search were information on assets and personal details of Kachikwu.

10. Also, following the arrest of three former Airforce chiefs by EFCC, namely, Alex Badeh, Umar and Amosu from whom huge sums of money and property were recovered, Umar and Alex Badeh were arraigned in court. It was only after the arrest of Mohammed by this service that the EFCC hurriedly arraigned Amosu. Mohammed later confessed that he never wanted Amosu tried, describing him as his former boss and he saw in MAGU, a willing accomplice.

“11. Furthermore, findings revealed that in a bid to settle some personal scores, subject placed one Stanley Inye Lawson on a Security Watch Action, while in actual fact Lawson was working in the interest of the Federal Government.

However, the action was later expunged following the discovery that Lawson was falsely accused by Magu for personal reasons.

“12. The circumstances surrounding Magu’s return to EFCC at the instance of the former chairman, Lamorde, and their close working relationship ever since is a clear indication of his culpability in the allegations of corrupt tendencies of the Lamorde led EFCC.

“13. To cover his tracks, Magu uses only his police cronies to execute operations. This, coupled with discoveries that such police cronies have acquired a lot of landed property, lends credence to the questions about his integrity.

“14. In the light of the foregoing, Magu has failed the integrity test and will eventually constitute a liability to the anti-corruption drive of the present administration.”

15. Accept the assurances of the esteemed regards of the DGSS, please. Folashade Bello

Revealed: The Secrets Behind The Rejection Of Ibrahim Magu As EFCC Chairman

A journalist working with the British Broadcasting Corporation has aired her seeming disaffection with the decision of the Nigerian Senate to reject the confirmation of the Acting Chairman of the Economic and Financial Crimes Commission (EFCC), Ibrahim Magu.

After a lengthy period of screening of Mr. Ibrahim Magu by the Red Chamber, a majority of the lawmakers rejected his confirmation for a second time.

BBC journalist Stephanie Hegarty has questioned the capacity of the Senate to disqualify Magu considering the fact that the Senate President, Bukola Saraki and 10 others are being investigated by the EFCC for corruption...

I Can’t Remember How Much We Have Recovered From Looters – Magu Replies Senate

Ibrahim Magu

Ibrahim Magu, Acting Chairman of the Economic and Financial Crimes Commission, EFCC, on today said he can’t remember how much the agency has recovered from looters so far.

Ibrahim Magu said this during today's before the Nigerian Senate

Reacting to a question from Senators Duro Faseyi who asked, “How much funds has been recovered since you took charge of the commission?”, Magu replied: “It is difficult to give report on how much has been recovered from fight against corruption,” adding that “It is very difficult for me to say.”

Meanwhile, the Senate again refused to confirm Magu as the Chairman of the anti-graft agency.

Also, during his screening, Magu questioned the integrity of the Department of State Security, DSS.

“What does it mean if same institution can submit two different reports on one person on a single day”, he quipped after Senator Dino Melaye confronted him with a report by the DSS.

Neither Senate Nor DSS Can Stop Me Fighting Against Corruption — Ibrahim Magu

Acting EFCC Chairman, Ibrahim Magu
Acting Chairman of the Economic and Financial Crimes Commission (EFCC) Ibrahim Magu, has vowed to continue the fight against corruption, stressing that neither the rejection of his nomination by the Senate nor the report by the Department of State Security (DSS) that he is ‘unfit’ to head the anti-graft agency can stop him.

Magu said this when he addressed a coalition of civil society groups at the entrance to the National Assembly.

“My priority is to fight corruption. My confirmation has not changed anything. We have always been on duty I will work until the last day whether confirmation or no confirmation.

“The greatest violation against human right is crime against the society and the humanity but everybody has a duty and responsibility to fight corruption and I also has a responsibility. I assure you that we will fight to finish.

“We will never be deterred because what we are doing is trying to investigate what has gone before and protect the future of our children and our future generation. So, if we don’t work today and fight against corruption, the future is not guaranteed, the future of our children is not guaranteed.

“So, we must wake up, where ever you find yourself, fight corruption. Anytime you discover that I am corrupt, expose me.”

BREAKING! Senate Rejects Magu As EFCC Chairman

Acting EFCC chairman, Ibrahim Magu
Acting EFCC chairman, Ibrahim Magu
The Nigerian senate on Wednesday, again rejects Mr. Ibrahim Magu as the Chairman of the Economic and Financial Crimes Commission (EFCC).

Mr. Ibrahim Magu remains the acting Chairman
Ibrahim Magu’s name was first submitted before the senate by Mr. President late last year. Mr President however resubmitted Magu’s name on the 23rd of January, 2017 after consulting with the leadership of the Senate.
The Nigerian senate on Wednesday (today) however turned down his confirmation, citing security reports as reason why it would not go ahead to confirm Magu.
While answering questions from the Senators on the allegations preferred against him by the security agencies, Magu said he was arrested and detained by the Nigerian Police for over 2 weeks, over the allegation that he was carrying official files and documents.
“I was locked longer than necessary for over 2 weeks, I was detained with armed robbers at Area 10.
“Another allegation was that, I was living in an apartment which belongs to Air Commodore Mohammed Umar.
“The truth was that, I was staying in Karu and was almost late for official assignment, so the authority got a new place for me”, Magu explained.
He gave a brief scorecard of his regime as acting Chairman of the EFCC, which includes, the $153m, $927m, £74,000 recently recovered from Andrew Yakubu and others, as well as the N49m recovered at the Kaduna Airport on Tuesday.
A mild drama however, turned out when the Senator representing Kogi West, Dino Melaye, drew the attention of the Senate to a security report submitted to the office of the Clerk on Tuesday, 14th March 2017.

Paragraph 14 of the said report reads in part: “In the forgoing, MAGU has failed the integrity test and will eventually constitute a liability to the anti graft agency”.
The letter which emanated from the office of the Department of State Security (DSS), was however faulted by Magu and some Senators.

Foreign Missions To Monitor Magu’s Screening By Senate

Some foreign missions and donor agencies will monitor today’s screening of Economic and Financial Crimes Commission (EFCC) Acting Chairman Ibrahim Magu. Besides, some Peoples Democratic Party(PDP) senators have opted to support Magu’s confirmation as the fourth chairman of the anti-graft agency. The senators reportedly met yesterday.

It was also learnt that Senate President Bukola Saraki briefed the leadership of the chamber on the controversial reports of the Department of State Services (DSS) on Magu. But the details of the brief were kept under wraps as at the time of filing this report.
The embassies, The Nation learnt, directed some of their desk officers, mostly in the intelligence unit, to monitor the confirmation.
Although the notice of the screening was sudden, more than 10 foreign missions and donor agencies have put some officials on the alert to monitor the session.

A top official of one of the missions said: “We heard of the confirmation notice at short notice but we have put all steps in place to monitor the process. “We are interested in Magu’s screening because it might determine the direction of your anti-graft war.
“So far, I think we are about 10 missions and agencies that have compared notes on the screening.” Another said: “We were caught unawares but we will send a representative to the screening to watch the development.
“We want to monitor the process to gauge the mindset of the Senate and Magu.” Responding to a question, the source added: “Some intelligence organisations collaborating with EFCC are interested in the screening too.”

Following the persistent intrigues over Magu’s fate, there is anxiety among some donor agencies, anti-graft war partners and foreign missions. Most of them rate Magu highly.

Some of the donor agencies and partners that have collaborated with the EFCC include United Nations Office on Drugs and Crime (UNODC), US Justice Department, the DFID, FBI, the National Crime Agency( NCA), the Metropolitan Police, the Interpol, City of London police, Serious Organized Crime Agency(SOCA), UK-sponsored Justice 4 All (J4ALL) , the Commonwealth Secretariat, the Western Australia Police and some foreign missions. The UNODC project led to the treatment of more than 5000 petitions, 400 convictions and the recovery of about $6.5billion criminal proceeds.

Some of the assistance to EFCC are as follows:
•The US Federal Bureau of Investigation(FBI) donation of a forensic work station, titled F.R.E.D (Forensic Recovery of Evidence Device).
•The payment of forensic accountant that assisted the EFCC to uncover those accused in the fuel subsidy fraud.
•Joint tactical and operational activities like collaboration with the Interpol, City of London police, Serious Organized Crime Agency(SOCA).
•NCA collaboration with EFCC to probe the oil sector during the tenure of a former Minister of Petroleum Resources, Mrs. Diezani Alison- Madueke.
•Ongoing MoU between EFCC and Western Australia Police are to combat internet fraud and money laundering.

It was learnt that some of the opposition senators claimed that they had decided to support Magu out of their belief in the anti-graft war and commitment to a new order.

Ibrahim Magu Remains EFCC Boss

President Muhammadu Buhari has once again sent the name of Ibrahim Magu, the current acting chairman of the Economic and Financial Crimes Commission (EFCC), as his candidate for the substantive chairmanship of the anti-corruption agency.

A highly placed source at the Presidency told SR that Mr. Magu’s name had been forwarded to the office of Senate President Bukola Saraki.

“I can confirm that President Buhari submitted Ibrahim Magu’s name just before he began a 10-day vacation in Britain on Thursday,” the presidential source revealed.

In a controversial move, the Senate had two months ago rejected Mr. Magu as the substantive leader of the EFCC. In refusing to confirm Mr. Magu, some senators claimed that they were relying on a security report prepared by the Director-General of the Department of State Services (DSS), Lawal Daura, which accused Magu of acting in a high-handed manner as well as being entangled in a conflict of interest with an allegedly corrupt Nigerian businessman.

Following the Senate’s rejection of Mr. Magu, President Buhari set up a panel led by the Attorney General of the Federation, Abubakar Malami, to probe the allegations against him.
