An Abeokuta
High court sitting in isabo, has sentenced a man identified as Kola Akanji to
death by hanging over an armed robbery attack.
The convict
was charged with conspiracy to commit armed robbery, contrary to section 6 (b)
2 and 1 (2) (a) of the robbery fire arms (special provision) laws of the
federation of Nigeria 2014.
The Presiding
judge , justice Abiodun Akinyemi, said
the punishment of the crime of armed robbery and conspiracy to commit
armed robbery and fire arms act section 1 (2) (a&b) and 6 (b) of the act is
death, and the court has no discretion
on the matter.
He said,
having found the accused guilty as charged on both counts, the court has no
choice but to impose on the accused the capital sentence as prescribed by the
law.
He therefore
sentenced the accused to death by hanging.
Earlier, the
prosecution brief was that the convict committed the offence on December 16,
2010 in company with two others.
He said, the
convict with two others robbed one fashola Moses of his motorcycle after
hitting him on the head with a bottle.
However, the
complainant, Moses Fashola said, he carried the accused and two others with his
commercial motorcycle at Ijaka Isale, Yewa North Local Government Area of Ogun
state on a trip to Ishaga Olowu.
Fashola said,
on the way just after Onigbedu, the motorcycle ignition switched off, not
knowing that it was the passenger who sat at the front that switched it off.
"The
acussed and two others rode away with my motorcycle after hitting
me bottle on my head.
"After i
stood up, I stoped another motorcycle coming, and boarded it to purse the
accused and other two.
"Two of
the robbers escaped, but only the accused was caught by the villagers, which i
recognized him at once.
"When i got to the police station at
onigbedu, the police paraded the accused who i recognised
immediately" Fashola said
